1. About these terms

These terms govern your use of GroundMatch (groundmatch.co.uk). GroundMatch is operated by Stephenson Engineering Solutions Ltd, a company registered in England and Wales (company number 16696208). Our registered office is Windsor House, Troon Way Business Centre, Humberstone Lane, Leicester, England, LE4 9HA. Contact: support@groundmatch.co.uk.

GroundMatch is currently in an external business trial phase. Features may change, be suspended or be withdrawn.

2. Who may use GroundMatch

GroundMatch is for business use only. To register or use it, you must:

• be aged 18 or over;
• act for a business or professional purpose, on behalf of a business that you are authorised to bind.

Consumers may not use the service.

3. Your account

You must give accurate information and keep it up to date. You must keep your password confidential. You are responsible for all activity on your account. Tell us promptly at support@groundmatch.co.uk if you think your account has been misused.

4. What GroundMatch does

GroundMatch helps businesses list surplus materials, post requirements and contact each other. We are not a party to any agreement between members. We do not own, inspect, test, certify, transport or dispose of any materials. Any sale, exchange, collection or delivery is agreed directly between the members involved and is their responsibility.

Distances, costs, carbon savings and other figures shown on GroundMatch are estimates only.

5. Listings and materials

You are responsible for the accuracy of your listings, including the description, quantity, condition, location and any contamination or classification.

• Asbestos is prohibited. You must not offer, list or seek asbestos, or materials known or suspected to contain asbestos, through GroundMatch.
• Other hazardous or controlled materials (including contaminated soils and controlled waste) may be listed only where their possession, description, transfer, transport and disposal are lawful and comply with all applicable requirements. This includes waste duty of care, waste carrier registration, permits or exemptions, and required documentation such as waste transfer notes.

You must not list anything unlawful, misleading or that you have no right to supply.

6. Acceptable use

You must not:

• misuse the service or try to access other members' accounts or data;
• interfere with the site's security or operation;
• scrape or harvest data;
• send spam;
• impersonate another business;
• use GroundMatch for any unlawful purpose.

7. Content you provide

You keep ownership of the content you add, such as profile text, logos, gallery links and listings. You give us a non-exclusive licence to host and display it for the purpose of running GroundMatch. You confirm that you have the right to use that content, including any images you link to.

8. Fees

GroundMatch is currently free to use during the trial. If we introduce charges, we will tell you in advance, and you will not be charged unless you agree.

9. Suspension and termination

We may suspend or close accounts that breach these terms or put other users or the service at risk. You may delete your account at any time from Company Settings. The Privacy Policy explains what happens to your data when you do.

10. Our liability

The service is provided "as is" during the trial. We do not guarantee that it will be uninterrupted or error-free, or that any match or transaction will happen.

We are not liable for:

• the conduct of members;
• the quality, safety, legality or description of materials;
• any agreement between members;
• loss of profit, revenue, business or goodwill, or any indirect or consequential loss.

Nothing in these terms limits or excludes liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be limited or excluded.

11. Changes to these terms

We may update these Terms of Use from time to time. The current version will always be published on this page, and the "Last updated" date will show when it was last revised. Where a change is significant, we may also notify registered users by email or through a prominent notice on GroundMatch. If you continue to use GroundMatch after a change takes effect, you accept the updated terms.

12. Privacy

Our Privacy Policy explains how we use personal data.

13. Governing law

These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
